All original works created by ONLYBADVISUALS // OBV, including but not limited to photography, design, motion graphics, video, and written materials, are protected under the Copyright Act 1994 (New Zealand). Copyright automatically vests in ONLYBADVISUALS // OBV at the time of creation. Clients are granted usage rights strictly according to the terms outlined in their project agreement. Ownership of the work remains with ONLYBADVISUALS // OBV unless explicitly transferred through a written agreement. Unauthorized copying, distribution, adaptation, or commercial exploitation of the work is prohibited under New Zealand law.

TRADEMARKS & BRAND ASSETS

The ONLYBADVISUALS // OBV name, fused OBV monogram, logos, and identity elements are protected as trademarks under the Trade Marks Act 2002 (New Zealand) and common law. Use of these marks is restricted to approved projects and collaborations. Any reproduction, modification, or use outside the agreed context requires prior written consent.

FONTS & LICENSING

The typefaces Chivo Mono and Inter are licensed under SIL Open Font License (OFL). Fonts may be used solely for work related to ONLYBADVISUALS // OBV projects and may not be redistributed, embedded, or incorporated into commercial products without permission or in violation of the license.

IMAGERY, MEDIA & RELEASES

All images, videos, and media produced under ONLYBADVISUALS // OBV are protected by copyright and may only be used in accordance with the client’s licensing agreement. Proper model releases, location permits, and third-party permissions must be obtained and adhered to at all times. Reuse, resale, or modification of media outside the agreed scope is not permitted.

ATTRIBUTION & CREDIT

Proper attribution is required whenever ONLYBADVISUALS // OBV media, creative assets, or intellectual property are used, displayed, or published outside of internal project purposes. This includes images, videos, motion graphics, designs, and any other original work created by the agency. Attribution ensures that credit is given to the creators, preserves the integrity of the work, and reinforces the brand identity. Watermarks, metadata, or embedded credits must remain intact unless written permission is provided by the agency.

Clients are responsible for ensuring that any third parties, partners, or collaborators who have access to ONLYBADVISUALS // OBV materials also comply with attribution requirements. Failure to provide proper credit or altering attribution without permission may be considered a breach of agreement and can result in corrective measures or legal action. Attribution also extends to derivative works, presentations, and digital or print media where the agency’s content is incorporated, ensuring visibility and acknowledgment of the agency’s contribution at all times.

CLIENT RESPONSIBILITIES

Clients are responsible for the use, storage, and management of all media, materials, and creative assets provided by ONLYBADVISUALS // OBV in accordance with the terms specified in their project agreement. All use, reproduction, distribution, modification, or publication of such materials must be consistent with the scope, purpose, and permissions outlined in the agreement. Clients are expected to maintain the integrity of the work, including visual, conceptual, and branding elements, and ensure that any attribution or credit is applied as required by the agreement.

Responsibility for obtaining any third-party permissions, releases, consents, or licenses necessary for lawful use of the materials rests solely with the client. Unauthorized or improper use of materials may result in suspension of rights, corrective action, or other remedies as provided in the agreement. The obligations and restrictions on usage, ownership, and intellectual property remain subject to the specific terms and conditions established in each individual contract.

DISPUTE RESOLUTION

In the event of a dispute regarding intellectual property or legal usage, parties agree to attempt resolution in good faith through negotiation or mediation before pursuing legal action. All matters are subject to the laws of New Zealand and the exclusive jurisdiction of New Zealand courts.
